Update on United States vs. Raymond Neal Boze (Crim.No. 4:07-CR-042-Y):
According to the court documents filed in the U.S. District Court for the
Northern District of Texas yesterday, Raymond Boze entered a guilty plea
yesterday before Magistrate Judge Charles Bleil on the Information alleging
one count of mail fraud, in violation of 18 U.S.C. section 1341. The
Magistrate Judge accepted the guilty plea and pronounced Boze guilty in open
court. (Technically, Boze has ten days to object to the Magistrate Judge's
findings or other actions, by filing those objections with the U.S. District
Judge).
A Factual Resume was filed, setting out the essential facts of the case, and
the court ordered the defendant to be sentenced on August 27, 2007, at 10:30
a.m. Boze's detention was ordered to be continued, and he was remanded to
the custody of the U.S. Marshal.
I attached the Factual Resume as a PDF file over on the
www.reso-nation.orgsite. It contains the essential elements of the
offense and the stipulation
of facts that support the guilty plea.
The U.S. District Judge, Terry R. Means, then entered an Order Setting
Schedule for Sentencing. This orders the probation officer to conduct a
presentence investigation and prepare a presentence report, with the counsel
for the United States of America (the Assistant U.S. attorney handling the
case, in efffect) to deliver to the probation officer a written report
setting out with specificity all information relevant to the sentencing or
the acceptability of the plea agreement, including:
(1) all criminal history of the defendant [Note: to my knowledge, Boze has
no prior criminal convictions];
(2) all criminal conduct of the defendant (whether or not charged) occurring
at any time;
(3) all statements made by the Defendant and related notes;
(4) all investigative reports pertaining to the offense and to relevant
conduct;
and, in any case in which restitution can be ordered as a result of the
defendant's criminal conduct, to the extent known to the government, the
full names of all identified victims of defendant's criminal conduct for
which restitution can be ordered, the amount of loss subject to restitution
for each identified victim, and related information.
The probation officer is ordered to deliver the presentence report to the
Court by July 5. Written objections to the report are to be filed/delivered
by July 18. Sentencing memoranda and character letters are to be submitted
by August 1. A sentencing recommendation from the probation officer is due
on August 21, and the sentencing hearing is set for August 27, 2007 at 10:30
a.m.
At the sentencing hearing, the parties present evidence, arguments, and
legal authorities with respect to sentencing.
That's a summary of yesterday's court action. I would encourage ALL VICTIMS
to make sure the probation officer has full information with respect to
their losses and the extent of the harm caused to individuals and this
community by the criminal actions of this defendant. I believe all
identified victims (those of you who have been getting letters informing you
of court dates) will be receiving a letter from the probation officer in
this regard.
