I forgot to mention the saddest part of this story. Matt/Ray is
accused of mail fraud. Mail fraud is a federal offense and is meant
to apply to people that made solicitations by mail that crossed state
lines for services (like building a dobro) that they never intended
to fulfill. It is a federal offense because it crosses state lines.
Of course it has been extended to include any solicitation made over
any interstate carrier like UPS, Fedex or anything on the internet
like Paypal (Matt's favorite mechanism).
Jim Heffernan was clearly defrauded by Matt/Ray, but it is not clear
to me that it is technically "mail fraud" in the classic sense. But
at the same time, as Matt lived in Texas and Jim in Philidelphia, the
promise crossed state lines, so maybe it applies. So Betty, what is
the law here? I hope that Jim, as the largest victim, will have a
say in the sentencing, but does he have a claim except under your category (2):
"(2) all criminal conduct of the defendant (whether or not charged) occurring
at any time;"
