Ever since the first posting of this topic by John Dopyeras son John,
I have been trying to get a clear picture of what he was talking
about. Part of my reasoning for this was a veiled comment that he had
made at last years "Gathering" that related to the same issue, I
started by doing a search for Patents/Trademarks and wound up on the
US Governments site, http://www.uspto.gov/ , and forwarded this to
John to allow him to post this information on the resoguit-l site
which should have cleared the air as to who owns the trademark. John
replied to me in regards to my email and stated that this was not the
whole story, but never did give me any information which would have
contradicted what is on the government site. I waited a couple weeks
and then informed John that someone else had already posted this same
information on the reso-nation site and that I felt a necessity to
put the same information on the resoguit-l site unless he could
explain the reason for his steadfast opinion that his aunt Gabriela
did not own the trademark, (from the information on the government
site I would say that no one individual owned the rights to the
trademark name Dobro, but that whoever owned the OMI company also
owned the trademark. A search of the Patents/Trademarks government
site will reveal that in 1974 Ed Dopyera who at that time was the
president of OMI assigned the trademark "Dobro" to the OMI Corp. I
think this is the area that John may have a problem with, however it
appears that in the legal world the action taken by Ed was totally
legal and the rest is history. So based on what we know as found on
the government site when Gibson purchased the company they also
bought the trademark. I would think that with the legal beagles that
Gibson would have had sniff this out that nothing would have been
overlooked. Further information shows that both Chester and Mary
Lizak had passed away in 1993 (the same year that Gibson bought OMI)
Chester in April and Mary in December, this may further explain why
Gabriela was involved in the sale if in fact she was. I have been
waiting now for over a month for a reply from John and have heard
nothing so I am posting this hoping it will clarify who in fact owns
the "Dobro" trademark.
